A federal judge has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement lacks lawful basis.
"Since his return from erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her order.
The case stems from a erroneous deportation to El Salvador in March, which the government later acknowledged was an error. After his repatriation to the United States to answer human smuggling allegations, he was detained in immigration detention.
In her decision, the judge noted that the government does not have a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."
